A Port Harcourt High Court presided over by Justice Chiwendu Nworgu has adjourned to August 19, 2021 for judgement in a suit filed by the Rivers State Government seeking to set aside the judgement delivered by Justice Ollor also of the State High Court which released one hundred and fifty prisoners from the Port Harcourt Correctional Centre.
Counsel to the Rivers State Government, C.N. Eke who moved the motion filled by the State Government urging the court to set aside the judgement of Justice Ollor, argued that the judgement was obtained based on fraud and misrepresentation of facts by the defence counsel.
The Defence Counsel, Oluchi Omereji in her argument, emphasized that a Judge lacks jurisdiction to sit on an appeal over a decision delivered by his learned brother.
Radio Rivers Judiciary reporter reports that Justice Ollor had earlier delivered judgement on unconditional release of one hundred and fifty inmates from the Port Harcourt Correctional Centre after spending more than nine years without trial since their remand.
